3、投標人資格要求
投標人應具備的資格或業績:（1）投標人是響應招標、已在招標機構處領購招標文件并參加投標競爭的法人或其他組織。任何未在招標機構處領購招標文件的法人均不得參加投標。
The Bidder is legal person or other organization that has purchased the Bidding Document from the Tendering Agent, and has participated in the bid. Any legal person or organization that has not purchased the Bidding Document from the Tendering Agent is not allowed to participate in the bid.
（2）凡是來自中華人民共和國或是與中華人民共和國有正常貿易往來的國家或地區（以下簡稱“合格來源國/地區”）的法人均可投標。
This Invitation for Bids is open to all legal persons or other organizations within the People’s Republic of China (hereinafter abb. as “PRC”) or from all countries/areas which have regular trade relations with PRC (hereinafter called “the eligible source countries/areas”).
（3）與招標人存在利害關系可能影響招標公正性的法人不得參加投標。
Any legal person or other organization that has conflict of interest with the Tenderee and may have impact on fairness of the bidding is not allowed to participate in the bid.
（4）接受委托參與項目前期咨詢和招標文件編制的法人不得參加受托項目的投標，也不得為該項目的投標人編制投標文件或者提供咨詢。
Any legal person or other organization that has been entrusted to provide consulting service at the preliminary stage of the project or to prepare the Bidding Document is not allowed to participate in the bid, nor to prepare bid documents or provide consulting service to the Bidder.
（5）單位負責人為同一人或者存在控股、管理關系的不同單位，不得參加同一招標項目包投標，共同組成聯合體投標的除外。
Different Bidders that have the same person in charge or have the relationship of share-holding or management should not participate in the bids for the same package. except for the case to form a Joint Venture to bid.
（6）只有在法律上和財務上獨立、合法運作并獨立于招標人和招標機構的供貨人才能參加投標。
The Suppliers may participate in the bids only if they are legally and financially autonomous, if they operate under relevant law, and if they are not a dependent agency of the Tenderee or the Tendering Agent.
（7）投標人應當于招標文件載明的投標截止時間前在中國國際招標網（網址：http://www.chinabidding.com）成功注冊。否則投標人將不能進入招標程序，由此產生的后果由其自行承擔。
Bidders should successfully complete the registration on http://www.chinabidding.com (hereinafter abb. as “the Website”) prior to the deadline for submission of Bids stipulated in the Bidding Document. Otherwise, the Bidders cannot enter into bidding procedures, and any consequence arisen thereafter shall be borne by Bidders.
（8）投標人必須是專業的設備制造商，須提供“制造商資格聲明”（格式見第一冊第四章格式IV-9-2）。中國境內投標人須提供的營業執照副本復印件；中國境外投標人的公司須提供注冊證明文件復印件。（掃描件需加蓋投標人公章，國外的投標人只需被授權人簽字）；
The Bidder shall be professional equipment manufacturer. “Manufacturer Qualification Statement” shall be provided (the format is as per IV-9-2 in Chapter IV of Volume I). Copies of business licenses shall be submitted by bidders in China and copies of registration certificates shall be submitted by bidders abroad.（sealing with company stamp for domestic bidders, while only signing for bidders abroad）
（9）投標人自2014年1月1日至今，至少有國內糊樹脂閥口袋包裝機2個有效業績合同，每個有效業績合同至少包含1臺能力達到300袋/h（20kg/袋）的閥口袋包裝機。
The bidder must have the experience of at least two valid contract for Valve Pocket Packaging Machine in paste resin plant in China since January 1, 2014, and each valid contract includes at least one Packaging and palletizing equipment with a capacity of 300 bags/h (20kg/bag) or more.
有效業績的認定條件為：The successful experience shall be identified upon:
提供投標人業績清單（格式見第六章附表1），并附合同等證明材料。證明材料須加蓋投標人公章（如為國外投標人只需被授權人簽字）。業績清單包括用戶名稱、購置時間、設備型號、設計產能、應用產品等信息，合同掃描件須體現合同蓋章頁、采購數量、單臺能力、合同簽訂日期、糊樹脂閥口袋包裝機等信息，日期以合同簽訂日期為準 。
The experiences list (the format as per Attached Table 1 of Section Six for the format of performance list), together with the certifying and supporting documents, such as copy of contract. The supporting documents shall be stamped with the official seal of the bidder, while the signature of authorized person is acceptable for the foreign bidder. The experiences list shall include the user name, purchase time, equipment model, design capacity, applied products, etc. The scaned copy of contract shall include seal page, procurement quantity, unit capacity, contract signing date, Paste resin valve pocket packaging machine, etc. The effective experience recognition date shall be based on the contract signing date.
（10）投標人須提供承諾書，承諾書中需明示：其提供的投標材料真實有效，如在由招標人組織的考察活動中發現投標材料與實際情況不符，自愿接受招標人提出的整改條件，同意其投標被否決，或其簽約后的合同被廢除等情況。
The bidder must provide a letter of commitment, which shall clearly indicate that the bid materials provided are true and effective. If the bid materials are found to be inconsistent with the actual situation in the inspection activities organized by the tenderee, the bidder is willing to accept the rectification conditions proposed by the tenderee, agrees that its bid is rejected, or revoke the contract after signing, etc.
（11）投標人具有良好的銀行資信，企業財務狀況良好，具備履約能力，無不良經營行為。投標人須提供投標人開立基本賬戶的銀行所開具的有效期內的銀行資信證明、經會計師事務所審計的2023年度財務審計報告復印件。投標人為中華人民共和國以內企業的（不含港澳臺地區，下同），復印件需加蓋公章的；國外的（含港澳臺地區，下同）只需被授權人簽字。
The Bidder shall have good bank credit, good financial status, ability to perform contracts, and no bad business practices. Bidders shall provide the original Credit Certificates issued by the bank where his basic account is open, and the copy of Annual Audit Report of 2023 with its company sealing for domestic bidders(excluding Hong Kong, Macao and Taiwan, the same below), while only signing for bidders abroad(including Hong Kong, Macao and Taiwan, the same below).
（12）投標的投標代表須提供法定代表人授權書（格式見招標文件第一冊第四章，格式IV-8）、法定代表人身份證明書及被授權人的身份證明（身份證）；如負責本次投標的代表為該公司的法定代表人，須提供有效的該公司法定代表人身份證明書和該法定代表人的身份證明（身份證）。
Power of Attorney of legal representative (the format is as per Section 4 Form IV-8,ITB Volume One), Certificate Identity of legal representative and the Identification Card of the authorized representative shall be provided; if the authorized representative for the bid is the company’s legal representative, the qualified company’s legal representative certificated and his Identification Card shall be provided.
